of Use
Who you are agreeing with
Psyke is made by António Sousa, an individual developer established in Portugal. Using the app means accepting these terms. If you do not accept them, do not use Psyke.
Psyke is not intended for anyone under 16. If you are under the age of majority where you live, you may only use Psyke with the agreement of a parent or guardian.
What Psyke is
Psyke asks you a short quiz, gives you one of twelve cinematic archetypes, and curates films and series around it. The archetype is an editorial device for recommending films. It is not a psychological assessment, a diagnosis, or advice of any kind, and nothing in the app should be read as such.
Psyke does not stream anything. It recommends titles and tells you where they can be watched; watching them is between you and whoever holds them.
Your account
Most of Psyke works without an account. Signing in with Apple adds sync across devices and the friend match. You are responsible for the Apple ID you sign in with.
You can delete your account at any time in Profile → Settings → Delete account. We may suspend or close an account that breaks these terms, or that is used to attack or abuse the service.
Subscriptions and billing
Psyke Premium is sold as an auto-renewing subscription through the Apple App Store. The price shown in the app is the price for your App Store storefront, in your currency, and it is always the price Apple charges you.
- Payment is charged to your Apple ID when you confirm the purchase.
- Renewal is automatic unless you turn it off at least 24 hours before the current period ends.
- Free trial. If a plan includes one, cancelling more than 24 hours before it ends means no charge. Starting a subscription forfeits any unused part of a trial.
- Cancelling is done in iOS Settings → your name → Subscriptions. We cannot cancel it for you.
- Deleting your Psyke account does not cancel the subscription. Those are two separate things, and only the second one stops the billing.
Refunds are handled by Apple under their terms, at reportaproblem.apple.com.
If you are a consumer in the EU you normally have 14 days to withdraw from a digital purchase. By starting to use Premium immediately you ask us to begin performance right away and accept that the right of withdrawal ends once it is fully performed. This does not affect your statutory rights, or Apple's own refund policy, which may be more generous.
Prices and what Premium includes can change. Changes never apply retroactively to a period you have already paid for, and a price increase only takes effect at a renewal you are told about in advance.
Acceptable use
You agree not to:
- copy, scrape or resell the curated catalogue, the archetypes or their rankings;
- reverse engineer the app, except where the law says you may;
- attack, overload or probe the service or its infrastructure;
- use Psyke to break the law or someone else's rights;
- send abusive or unlawful content through the suggestions form.
The suggestions form is a private channel to us. It is not published, and nothing you write there is shown to other users.
What belongs to whom
The app, its design, the twelve archetypes and the editorial curation are ours. You get a personal, non-transferable licence to use Psyke on devices you control, for as long as these terms are respected.
Film and series metadata, synopses, cast and poster art come from The Movie Database (TMDB) and belong to TMDB and the respective rights holders. This product uses the TMDB API but is not endorsed or certified by TMDB. Trailers open on YouTube and are governed by YouTube's terms, not ours.
Your share card is yours to post wherever you like.
Availability and change
Psyke is given as it is. We do not promise it is uninterrupted, error-free, or that a particular title will always be there — the catalogue is curated and changes over time. We may add, alter or retire features.
If we ever discontinue the service, we will say so in advance in the app and stop charging for renewals.
Liability
Nothing here limits liability for death or personal injury caused by negligence, for fraud, or for anything the law does not allow to be limited — including your rights as a consumer, which stay intact whatever this page says.
Beyond that, and to the extent the law allows, we are not liable for indirect or consequential loss, and our total liability is limited to what you paid for Psyke in the twelve months before the claim.
Apple
Apple is not a party to these terms and has no obligation to provide support for Psyke. Apple is not responsible for the app or its content. Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you.
You confirm you are not in a country under a US embargo or designated as supporting terrorism, and that you are not on any US list of prohibited or restricted parties.
Law and changes to these terms
Portuguese law applies, and the Portuguese courts have jurisdiction. If you are a consumer elsewhere in the EU, you keep the protection of the mandatory rules of your own country and may bring proceedings there.
If we change these terms we will update the date at the top of this page, and announce material changes in the app before they take effect. Continuing to use Psyke after that means accepting the new version.
